After four nights in the hospital requiring emergency surgery due to a hear ailment, we’re positive that Prince Philip is glad to be home!! The 90 year old left the hospital in good spirits too, smiling and waving at people outside.

And there’s a soul musician named Syl Johnson and a lawsuit out there that says they crossed that line: In a complaint filed in Illinois federal court on Friday, Johnson claims the two famous hip hop artists plus UMG and Def Jam took a portion of his song, “Different Strokes,” used it on a song entitled “The Joy,” and released it in August without his permission and without giving him any credit or payment. Johnson says that West originally wanted to use the sample for his own solo album entitled My Beautiful Dark Twisted Family, but that the defendant was unable to obtain permission at the time of release. After failure to clear a license for the sample on one album, West’s use of the sample on another album without permission is said to be an example of knowing and willful misappropriation.

Unfortunately, Glee and The Biggest Loser have dipped, with Loser hitting it’s fall low. New Girl (8.6 million total viewers, 4.3 rating in adults 18-49 demographic), down 4 percent in the demo, was the highest-rated program of the night — and among the younger adults 18-34 category. Raising Hope (6.5 million, 2.9) remained steady from the previous week.

Oh no! Halle Berry broke her foot in Spain, and beyond the problem of it probably hurting like shizz, the cast and injury is interfering with the movie she’s shooting! It could be a major problem for Cloud Atlas ! She was apparently off set when the injury occurred and at her temporary living quarters where she’s staying during the shoot. She supposedly stepped down wrong and heard a snap, followed by intense pain. Luckily she was not involved in a serious accident of some type.

Wow! She’s really give it the old college try this time! Or at least her team is! Amy Winehouse was already spotted drinking in a London beer garden this week, four days after checking out of rehab for alcohol addiction, but apparently, she’s trying to get herself back on the wagon, and her management has banned her drinking during her upcoming European tour! Sources have revealed that Team Wino has informed EVERY hotel staff on her 12-date itinerary to remove all alcohol from the rooms she and her team have booked, and that they may not deliver any drinks.
